Terms of Service

Welcome to Gloiyk Properties & Investments (“Gloiyk,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, services, and all real estate–related engagements with us. By using our services or engaging us in any transaction, you acknowledge that you have read, understood, and agreed to these Terms.


1. About Gloiyk Properties & Investments

Gloiyk Properties & Investments is a real estate brokerage and advisory firm providing property marketing, sales facilitation, rentals, inspections, negotiations, and related advisory services within Nigeria.

We act strictly as intermediaries and facilitators, not as landowners unless expressly stated in writing.


2. Scope of Services

Our services may include, but are not limited to:

  • Property and land marketing

  • Buyer and tenant sourcing

  • Property inspections and viewings

  • Sales and rental negotiations

  • Transaction coordination and documentation support

  • Due diligence support and title verification assistance

  • Investment advisory (non-financial)

All services are rendered in accordance with applicable Nigerian laws and professional best practices.


3. Commission & Fees

3.1 Sales Commission

Gloiyk Properties & Investments charges a standard commission of five percent (5%) on the final agreed sale price of any property successfully sold through our efforts, unless otherwise agreed in writing.

Commission becomes due and payable immediately upon successful conclusion of the transaction, defined as when payment is received from the buyer or binding contractual commitment is executed.

3.2 Rental Commission

For rental transactions, commission shall be charged in line with prevailing market standards and as agreed with the client prior to engagement. This may include:

  • Tenant sourcing fees

  • Lease negotiation fees

  • Renewal facilitation fees

All rental commissions must be settled before or upon tenant move-in, unless otherwise agreed in writing.

3.3 Litigation & Negotiation-Related Engagements

Where Gloiyk is engaged to assist with dispute resolution, recovery negotiations, or transaction-related mediation, such services:

  • Do not constitute legal representation

  • May attract additional professional or negotiation fees

  • May require written engagement terms prior to commencement


4. Integrity, Transparency & Ethical Conduct

Integrity is central to our operations. All parties engaging with Gloiyk agree to:

  • Provide truthful and accurate information

  • Refrain from misrepresentation, concealment, or fraudulent conduct

  • Respect confidentiality of transaction details

  • Act in good faith throughout negotiations and transactions

Gloiyk reserves the right to withdraw from any transaction where unethical, illegal, or deceptive practices are identified.


5. Due Diligence & Disclaimer

While we assist clients with due diligence and verification processes:

  • Final responsibility for independent legal verification rests with the client

  • We do not guarantee government approvals, title perfection timelines, or third-party actions

  • We are not liable for losses arising from undisclosed government interests, force majeure events, or client failure to seek legal advice

Clients are strongly advised to engage qualified legal practitioners for final title confirmation.


6. Client Responsibilities

Clients agree to:

  • Make timely payments as agreed

  • Provide required documents and information promptly

  • Avoid bypassing Gloiyk in transactions introduced by us

  • Respect exclusivity agreements where applicable

Any attempt to circumvent agreed commissions after introduction of parties constitutes a breach of these Terms.


7. Property Listings & Information Accuracy

Property details, prices, and availability are subject to change without notice. While we strive for accuracy:

  • Listings are provided based on information supplied by property owners or developers

  • We do not warrant absolute accuracy of third-party information


8. Limitation of Liability

To the fullest extent permitted by law:

  • Gloiyk shall not be liable for indirect, incidental, or consequential damages

  • Our liability, if any, shall be limited to the commission earned on the specific transaction in dispute


9. Termination of Engagement

Either party may terminate an engagement subject to:

  • Settlement of outstanding fees or commissions

  • Survival of confidentiality and commission clauses for transactions already introduced


10. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising shall be subject to the exclusive jurisdiction of Nigerian courts.


11. Amendments

Gloiyk Properties & Investments reserves the right to amend these Terms at any time. Updated versions will be posted on our website with a revised effective date.
